How long do I have to file a personal injury claim in Florida?
Under Florida § 95.11(3)(a), as amended by HB 837 (2023), most personal injury victims have two years from the date of the incident to file a lawsuit. Certain exceptions apply — for example, claims against government entities require earlier notice. Do not delay; missing the deadline means losing your right to compensation entirely.

Does Florida's comparative fault law affect my claim?
Yes. Florida adopted a modified comparative negligence standard under HB 837 (2023). If you are found more than 50% at fault for your own injuries, you cannot recover any damages. If you are 50% or less at fault, your recovery is reduced proportionally by your percentage of fault. This makes early legal representation critical — insurance companies will try to shift blame onto you to reduce their payout.
