How long do I have to file a motor vehicle accident claim in Florida?
Under § 95.11(3)(a), as amended by HB 837 (2023), most victims have two years from the date of the crash to file a lawsuit. Florida's PIP system also requires you to seek medical treatment within 14 days of the accident to be eligible for PIP benefits. Don't delay — missing either deadline can cost you significant compensation.
What if the other driver doesn't have insurance?
Many Florida drivers are uninsured or underinsured. If the at-fault driver lacks sufficient coverage, your own UM/UIM policy may provide additional compensation. An attorney can identify all available coverage and pursue every source of recovery on your behalf.
Do I have to go to court?
